In the event of a failure of any warranted line item or component thereof to meet the conditions specified in
paragraph a. above:
(1) The contractor shall promptly repair, replace or modify such parts as are necessary to correct
defects, and the contractor shall bear the cost thereof; or
(2)
If the contractor fails to repair, replace or modify such parts promptly, as determined by the
Contracting Officer, the Contractor shall pay costs incurred by the Government in procuring
such parts from another source and in accomplishing the repair or replacement.
f.
The contractor shall be notified in writing of any failure of a line item or any component thereof subject
to the guarantee set forth in paragraph a. above within 60 days after discovery of the failure. Upon election
by the Government of a remedy in accordance with paragraph d. or e. above, the contractor will,
notwithstanding any disagreement regarding the guarantee, comply with such election. Correction of the
failure by the contractor shall be within 30 days of the Government notice. In the event it is later determined
that the failure was not subject to the guarantee set forth in paragraph a. above, the contract price will be
equitably adjusted.
g.
The contractor shall prepare and furnish to the Government data and reports applicable to any correction
required under this clause, in accordance with Data Item DI-A-1025 (including revising and updating all
affected data called for under this contract) and the contractor shall bear the cost thereof. A warranty
status report in accordance with Data Item DI-A-1025 shall be furnished by the contractor to the Government
as long as this warranty is in effect.
h.
The contractor shall repair/rework/modify all equipment utilized during testing to put them in like new
condition; and the warranty period for those items shall start at the time the equipment is delivered in
accordance with the date stamped on the equipment name plate or acceptance, whichever is later.
